TERMS & CONDITIONS

Borvemor Cottages are a collection of self-catering cottages owned and operated individually by extended family on one of the most beautiful locations in Scotland.

The following terms apply:
"Owner" shall mean the property owner for each booking, namely:
Black House: Mr A Bennett
   Beach House: Mr C Bennett

Stable & Byre Cottages: Mrs I Molleson

Vallay House Mr N Bennett

                   
"Customer" shall mean the individual who made the booking
"Tenants" shall mean the Customer's party

CONTRACT 
When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your deposit payment has cleared and your booking is subsequently confirmed in writing via a letter of confirmation sent by email.

GENERAL TERMS

  1. The Customer warrants that the properties let are to be used for the purposes of a holiday and so accepts that the letting is a holiday let to which Section 12(2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 apply, namely, "a tenancy the purpose of which is to confer on the tenant the right to occupy the house for a holiday."

  2. The Customer shall not sub-let the premises or any part thereof.

  3. The number of people occupying the premises shall not exceed the number stated for the premises.

  4. The Customer binds and obliges himself to vacate the hired premises without demand at the termination of the period of hire.

  5. The Owner has the right to arrange entry to the property with reasonable notice and arrangement for the purpose of necessary inspection, essential repair, etc.

  6. The Owner may treat the booking as cancelled if the balance of the payment is not received 42 days before the arrival date, and every effort will be made to re-let the vacancy.

  7. The Customer shall undertake to prevent any member of his / her party from causing a nuisance or disturbance to other residents, neighbouring occupiers or croft livestock.

  8. The Customer undertakes to leave the hired premises secure if left unoccupied during the period of let.

  9. The Customer undertakes to relieve the Owner from any liability for damage or injury, however caused, by any member of his party.

  10. The Owner, his agents or employees, accept no responsibility for loss, injury or damage to any member of the Customer's party or their property, howsoever caused, arising in any manner out of the let of the premises.  If for any reason the accommodation is not available to the Customer on the dates booked due to events beyond control of the Owner, then the Owner shall endeavour to find similar alternative accommodation but if unsuccessful all sums paid by the Customer will be refunded and the Owner will have no further liability to the Customer or any other party

    EXTRAS

  11. Refer to your cottage host for your electricity charges.  Use of the cottage mains electricity for charging vehicles is not permitted.  

  12. Solid Fuel is included in the cost of the holiday let for the Black House. 

  13. The cottages are not equipped with landline telephones.  Mobile reception can vary. 

  14. Free UK Satellite Television is provided in all the cottages, along with DVD players.  

  15. Reasonable Use of Wifi provision is provided in all the cottages.  Reasonable use does not include excessive streaming of video, as this uses up the maximum download data.

  16. Bedding, Fresh Linen, Fresh Towels and Toiletries are included in the let. 

  17. The Black House let includes exclusive use of the Outdoor Hot Tub

  18. All the cottages are fully equipped for self-catering. 

    ADDITIONAL CHARGES

  19. In the following instances there will be additional charges:
    For breakages, loss or damage: The Customer should report by email to the Owner any deficiency which occurs during their stay. Where appropriate, the Customer will be liable to pay the replacement cost of the item broken, lost or damaged, if directly responsible.

    When Tenants leave the house, furniture or equipment dirty. The house will be in a clean condition on Tenants’ arrival, and Tenants must leave it in a like condition.  We do clean the properties between each let as a matter of course, but the Owner reserves the right to make a charge for additional cleaning required if the property has not been left reasonably clean.
    When Tenants arrive early or overstay the departure time: Time is required between tenancies in order to check the house before the next Tenants arrive. Occupation of the house will be given at 4pm of the first day of the holiday let. The house must be vacated by 10am on the last day of the holiday let. The right is reserved to charge for an extra day if tenants arrive before 4pm or have do not depart by 10am.
    Dogs. Tenants may bring up to two dogs to either Vallay House, Beach House, Stable Cottage or Byre Cottage. Please note one Dog may be allowed in the Black House if agreed on enquiry.  There is a fee of £10 per dog per week or part-week, and this should be indicated at booking.   Dogs must on no account be left unattended in these properties and owners reserve the right to charge for additional cleaning or damage incurred by Dogs in the Properties. ​

    FEES

  20. Deposit: Your booking will only be confirmed following receipt of the relevant holding deposit. The deposit is payable on booking and forms part of the total weekly rate for the property.  Holding deposits payable on each cottage are as follows: £200

  21. Balance: The balance is payable not less than 42 days (6 weeks) before the arrival date. You will be sent notification that the balance is due. If the balance of payment is not received by the stated date, the Owner has the right  to advertise those dates again, and the deposit will be forfeited.

  22. Security Deposit: If you have been asked to provide a security deposit with your booking, as per online submission,  then the charges associated with additional Owner expenses in condition 19 will be set against your Security Deposit if relevant, prior to return of remaining monies. 

  23. Payment Method: We receive payment by BACS transfer, Paypal, or Credit / Debit Card via our website Paypal option.  We do not accept Cash or Cheques.

    CANCELLATION TERMS

  24. The Customer may cancel within 7 days of the owners' confirmation of booking, whereupon the deposit will be returned in full.

  25. If the Customer cancels more than 42 days (6 weeks) in advance of the arrival date then the deposit will be retained by the Owner and any payment made on the full balance will be returned to the Customer.  The deposit will however be non-refundable, regardless of circumstances.

  26. If the Customer cancels within 42 days (6 weeks) of the arrival date, 100% of the rental fee will be forfeited.

    DISCLAIMER

  27. The Owners have taken every care to ensure the accuracy of property descriptions on their website, and all information is provided in good faith and is believed to be correct.

  28. In the event that any individual term or clause stated in this contract is not permissible by law, the remainder of the Contract shall remain valid.

  29. This Agreement shall be governed by and construed in accordance with the Laws of Scotland and shall be subject to the jurisdiction of the Scottish Courts.

  30. This does not affect your statutory rights.
